City Ordinances Passed in 2006 That May Affect You

What is an Ordinance?  An Ordinance is a law or rule that is made by the City Council.  An Ordinance, once adopted by the City Council, becomes a part of the City Code of Ordinances, frequently referred to as the “Municipal Code” or the “Code Book”.  Each City Department has several copies of the Code Book and you are welcome to come in and look at it.  The City Code is also available through this website on the City Council page.   

Below is a list of just a few of the City Ordinances that have been adopted in 2006.  If you would like more information, please call the City Clerk’s office at 209-863-7122, drop by City Hall North at 6707 Third Street, or email the City Clerk at labid@riverbank.org.

Ordinance 2006-002, adopted March 13, 2006

Amends Title 5, Public Works by adding Chapter 52, Storm Water Management and Discharge Control.

 

This Ordinance is intended to help protect our rivers and waterways by managing what is discharged through the storm drain system.

 

Ordinance 2006-003, adopted March 13, 2006

Amends Title 11, Business Regulations by adding Chapter 119, Massage/Bodywork Establishments.

 

This Ordinance was written because the City did not have any requirements for massage and/or bodywork-type establishments or therapists.  With this Ordinance in place, the City and/or Sheriff can make sure that these businesses are conducted lawfully.  

 

Ordinance 2006-005, adopted March 27, 2006

Amends Title 3, Administration, Chapter 34: Taxation, Section 34:21 Rate.

 

Amending the rate of tax imposed upon retailers (.995 percent of gross receipts of retailer from sale of personal property sold at retail in City, commencing July 1, 2006; tax rate to decrease each fiscal year  by .005 percent effective July 1 of each year; decrease to continue until rate is reduced to .950% which is where it will remain).

 

Ordinance 2006-006, adopted April 10, 2006

Amending Title 3, Administration, Chapter 33: Finance, Section 33.16 Bidding.

 

This section now provides detailed information on formal and informal bidding procedures, notice of invitation of bids (formal & informal), award of bids, rejection of bids, etc.

 

Ordinance 2006-008, adopted April 24, 2006

Amending Ordinance 2006-004 imposing a Moratorium on Medical Marijuana Dispensaries in Riverbank, pursuant to California Government Code Section 65858.

 

Because the legality of medicinal marijuana under Proposition 215 and SB420 is unclear the City will not allow medical marijuana dispensaries open within the City limits because doing so may not comply with the United States Supreme Court decision in Raich v. Ashcroft and could result in Federal charges.

 

Ordinance 2006-009, adopted May 8, 2006

Amends Title 15, Land Usage by adding Chapter 156: Oak and Landmark Tree Conservation.

 

The purpose of this Ordinance is to protect existing oak and landmark trees.  Per the definitions listed in this Ordinance, Oak Trees or Valley Oak Trees with a trunk diameter of two inches or greater at a point 4.5 feet above the root crown; and Landmark Trees are six inches or greater in diameter at breast height (DBH), in good health and of preferred species (in order) oak, deciduous, evergreen and other such trees with significant impact (including but not limited to: age, size, location, habitat value, beauty, historical or cultural significance. 

 

Persons wishing to remove Oak Trees or older trees over six inches in diameter, or a grouping of trees, should contact the City Planning Department for approval.

 

Ordinance 2001-012, adopted October 23, 2006

Amending Title 5, Public Works, Chapter 50: Garbage, Section 50.07 Refuse Collection Service, Commercial and Section 50:10 Rates to be Charged.

 

This amendment to the Code is specifically for commercial bins.  The City Council felt that having locks on the bins would keep unauthorized persons from rummaging through businesses trash and waste.  It was also thought that this might help eliminate some identification theft.
