Garage & Yard Sales/Signs
This page will focus on City
Codes, State Laws, and other items that may be of interest to
our residents and visitors. Codes and State Law vary from City
to City and State to State, and we are hoping this section will
help take some of the confusion out of our daily practices.
This page will be updated periodically and all articles will
remain accessible through our Archives. Most articles that
appear here will deal with the Riverbank City Code of
Ordinances, which is available for residents to examine in the
City Clerk’s office located at City Hall – North, 6707 Third
Street, Riverbank or you can access the Code via our website
from the City Council page (click on Municipal Code).
Recently, the Riverbank News
reported on signs, to be more exact, garage or yard sale signs
posted in the City’s right-of-way. First, it is not illegal to
hold a garage or yard sale within the City limits; however, you
are required to purchase a garage sale permit from the City.
The permit is $5.00 and is good for two sales during the
calendar year.
This is what City Code reads:
Riverbank City Code (RCC)
110.18 (C) – Garage Sales.
Garage sales conducted in any residentially zoned area shall be
subject to the limitations of any “home occupation” as set forth
in the Code of Ordinances.
(1)
All garage sales
must be licensed by the City.
(2)
The license fee
for a garage sale shall be $5 per calendar year, which entitles
the licensee to hold two garage sales per calendar year,
provided that each sale lasts no longer than three consecutive
days.
With a garage or yard sale
comes a sign or two or three. Signs show prospective buyers
where the sale is being held. The problem is you can’t just put
a sign up anywhere you want.
Referring to the posting of
signs, the Riverbank City Code (RCC) states the following:
RCC Section 153.284 (N) – No
signs on street trees, utility poles or structures in street
right-of-way. No
signs shall be attached to any street tree, or any poles such as
utility poles, street signals, streetlights, street name signs
or traffic warning signs, or on any bus shelter. (’67 Code,
§ 10-19-5)
And the following section goes
further –
RCC Section 153.285 (A)(1)(l)
– Two unlighted
garage sale signs not exceeding three square feet each in area
may be displayed as follows:
1.
The signs may be
displayed only during such times as the garage sale being
advertised is actually being held or conducted.
2.
The signs may
only be erected and displayed on private property with the
consent of the owner thereof. They may not be erected or
displayed on street trees, utility poles or elsewhere in public
right-of-way.
Both these sections are pretty
clear in their meaning – take your signs down immediately
following your garage sale and, if the tree is not on private
property (belonging to you or belonging to someone who has given
you permission to use) you cannot tape, tie, or nail a sign to
the tree. Posting signs on utility poles, street signs of any
type, or on bus shelters is illegal according to City Code.
